Should You Trademark Your Logo in India?

When Indian SMEs should file a trademark for a logo or name — classes, search, ™ vs ®, cost versus identity work, and what a Chennai branding studio will not pretend to be: your IP lawyer.

Founders treat a logo zip as a moat. It is not. In India, a trade mark is a legal right you apply for, wait on, and then police. A beautiful SVG sitting in Drive does not stop a cousin in another city from painting a similar board.

You still need the design. Filing a weak, copied, or unsearchable mark just documents a problem. Sequence: name hygiene, visual identity, then filing — or filing in parallel once the mark is frozen. See logo vs brand identity.

This is a decision guide for operators in Chennai, Tamil Nadu, and the rest of India. It is not a substitute for a trademark attorney. Laws, fees, and examination practice change. We will tell you when to call one, not how to argue your hearing.

Cost confusion is common. Brand Identity from ₹25,000 (Full ₹60,000) pays for a system you can use on websites and packs. Trademark invoices pay for classes, attorney hours, and time. Branding cost in India should never be quoted as “includes TM.”

If you are about to rename, read rebrand vs refresh before you file. Filing last year’s name is how you donate fees to nostalgia.

Registration is not the same as a logo file

Copyright in artwork, company incorporation, domain ownership, and trade-mark registration are four different things. Winning one does not gift the others. Instagram handle availability is a fifth, still not a registry.

Use the mark in commerce consistently. Ghost logos that never hit a pack or a site are harder to defend even after paperwork.

When an Indian SME should file, and when to wait

File when the name is locked, the drawing is frozen, you sell (or will sell) in identifiable classes, and a conflict would actually hurt. Wait when you are A/B testing three names this month or the “logo” is a Canva script font.

  • Stable legal and trading name — see naming checks
  • Clear goods/services description in ordinary language
  • Budget for search + filing + a watch, not only the first form
  • Someone who will notice copycats on Maps and Amazon

Word mark, device mark, and combined marks

Word mark: the name in standard characters. Device: the graphic. Combined: both, with less flexibility if you later restyle. Many Indian SMEs under-file the word and over-invest in a trendy monogram that will age out.

Classes, search, and the “similar sounding” trap

India uses a classification system. Filing in the wrong class is like insuring the wrong shop. Phonetic cousins (“Freshh,” “Phresh”) still collide. A proper search looks at lookalikes and soundalikes, not only exact spelling.

Designers can flag obvious clones in your category. They cannot clear a mark. If the search is scary, change the name before you print boards.

Cost and timeline versus identity work

Identity can ship in weeks. Examination can take much longer. Do not delay a website launch for a certificate that may arrive next year — but do not print 10,000 packs of a name you already know is taken.

Brevia floors stay public: Brand Identity from ₹25,000; UI/UX from ₹50,000. Trademark is extra and external.

Using ™ and ® without lying

Do not stamp ® on unregistered marks. Do not imply government endorsement. Put the mark on the site footer and packs the same way, every time. Inconsistency is how you teach customers the wrong drawing.

Rebrand, assignment, and old marks

Companies sell, merge, and restyle. Assignment and recorded changes are legal work. A new colourway is usually a refresh; a new name is a new filing conversation. Plan rebranding without losing Google rankings and IP in the same week, not as afterthoughts.

What Brevia will and will not advise

We will design distinctive marks, avoid lazy clip-art, and stop a brief that copies a neighbour. We will not guarantee registrability, draft objections, or quote official fees as if they were our package. Brief the agency with your attorney’s constraints if you already have them.

Frequently asked questions

No. Design creates artwork. Protection needs an application, examination, and (if all goes well) registration. Start with naming checks before you fall in love with a mark.

Word marks protect the name across stylings. Device marks protect the graphic. Many firms file both when budget allows. A logo-only filing will not stop someone using your name in a different drawing.

™ is commonly used to claim a brand; ® is for registered marks. Misusing ® is a problem. Confirm current practice with a trademark attorney — this guide is not legal advice.

Official fees plus attorney time are a different invoice from design. Identity from ₹25,000 does not include filing. Compare apples in how much branding costs in India.

Search first. Filing a mark you will abandon in 90 days wastes money. If the name is the company, file sooner. See startup vs SME branding.

Classes matter, but so does confusion in the market. An attorney reads search results; a designer should not “eyeball” the registry and declare you safe.

Material changes can weaken a device mark. Slight redraws are often managed; a new concept may need a new filing. Read rebrand vs refresh.

No. We design, we can share search screenshots as a conversation starter, and we will tell you to hire a trademark agent. Consultation from Chennai HQ is for identity scope, not Form TM.
